Oregon Couple Claims Shocking Fertility Error Cost Them Their Biological Family: ‘Severe Invasion Of Personhood’

A deeply unsettling lawsuit out of Oregon is forcing a spotlight onto the long-term consequences of fertility clinic errors and how those mistakes can ripple through an entire family for decades. An Oregon woman and her parents are now suing two major health systems after allegedly discovering that a fertility clinic inseminated her mother with the wrong man’s sperm more than 40 years ago.

According to court documents obtained by PEOPLE, the woman, identified as A.P., is joined in the lawsuit by her mother, C.W., and the man who raised her, K.W. Together, the Oregon family is suing Oregon Health & Science University (OHSU) and Providence Health & Services of Oregon for $17 million. They claim the error occurred when C.W. and K.W. sought fertility treatment after being referred by their physician, trusting the process would help them build their family.

Instead, the lawsuit alleges the clinic mistakenly mixed up K.W.’s sperm with another man’s, identified in court records as R.W. As a result, C.W. was allegedly inseminated with the wrong specimen entirely. At the time, no one involved had any idea something had gone wrong. C.W. and K.W. welcomed their daughter, A.P., in December 1981 and raised her as their biological child. Meanwhile, R.W. and his partner also became pregnant and welcomed a child just one month earlier, in November 1981.

Oregon Family Sues Decades After Fertility Error Changed Their Lives

The truth didn’t come to light until decades later. According to the lawsuit, A.P. only discovered that K.W. was not her biological father two years ago after undergoing genetic testing. Further testing allegedly confirmed that her biological father was R.W., not the man who raised her from birth.

The emotional fallout described in the lawsuit is significant. K.W. claims he was “stripped entirely” of his biological fatherhood of his first child and is permanently reminded of the violation against his family. C.W. alleges she was denied the chance to create a shared biological life with her husband and endured “humiliation, discomfort, and physical distress” while unknowingly carrying a pregnancy conceived with another man’s semen. She describes the experience as a “severe invasion of personhood.”

The lawsuit also focuses heavily on the impact on A.P. herself, describing her as the “product of nonconsensual birth.” The family claims she will live with doubt, frustration, and confusion for the rest of her life as a result of the alleged mistake. Even more troubling, they allege the hospital knew about the error and “concealed the use of R.W.’s genetic material,” refusing to acknowledge any wrongdoing.

The Painful Reality

Cases like this raise uncomfortable questions about oversight, accountability, and transparency in reproductive medicine, especially during an era when fertility technology was advancing faster than regulations could keep up. While DNA testing has made it easier for families to uncover long-buried truths, it has also opened the door to painful revelations that no one ever anticipated.

Now, the Oregon family is seeking $17 million in damages, hoping the lawsuit will bring accountability for what they describe as a life-altering breach of trust, one that reshaped their family without their consent.
